OLD LYME ZONING BOARD OF APPEALS
REGULAR MEETING
TUESDAY, OCTOBER 16, 2012
MEMORIAL TOWN HALL, 52 LYME STREET
OLD LYME, CT - 7:30 P.M.

Present and voting were Susanne Stutts, Chairman, Judy McQuade, Vice Chairman, Arthur Sibley, regular member, Richard Smith, alternate (seated for Joseph St. Germain) and Mary Stone, alternate (seated for Kip Kotzan)

Present: Ann Brown, Zoning Enforcement Officer

Absent:  Kip Kotzan, Secretary, Joseph St. Germain, regular member, and Martha Rumskas, alternate

Case 12-24C – Dominic J. Nardi, 115 Hillcrest Road

        A Motion was made by A. Sibley, seconded by R. Smith to GRANT the necessary variances requested for the garage.  No discussion and a vote was taken.  In favor:  None In opposition:  S. Stutts, J. McQuade, A. Sibley, R. Smith, M. Stone  Opposed:   None  The Motion failed to pass.  0-5-0  DENIED  It takes 4 affirmative votes to grant a variance.

Reasons the motion to grant failed:  S. Stutts stated that there would be a change in character of the site.  M. Stone stated that this is an environmentally precarious site that has already increased coverage and that given that a variance has already been granted to build a larger structure, the current proposal of the garage is too great a burden for this property.  

        A Motion was made by A. Sibley, seconded by M. Stone to GRANT the necessary variances requested for the construction of this new house for the 2’ height increase from the previously approved structure. Discussion:  J. McQuade stated 2’ height increase will make a big difference.  S. Stutts unique lot but not unlike others in this area, the 24’height was put into regulations to keep height down in certain areas.  A. Sibley stated neighbors house height the same.  J. McQuade stated street view would be impacted.  A. Sibley stated architecturally sensitive; S. Stutts asked what makes this plan unusual; M. Stone understands why they need the height increase but doesn’t understand why it wasn’t presented in the previous application.  No further discussion and a vote was taken.  In favor:  A. Sibley, R. Smith, M. Stone   In opposition:  S. Stutts, J. McQuade  Opposed:   None    The Motion failed to pass.  3-2-0  DENIED  It takes 4 affirmative votes to grant a variance.

Case 12-25 – Preston and Elaine Campbell, 8 Ridgewood Road

        A Motion was made by A. Sibley, seconded by J. McQuade to GRANT the necessary variances as per the plans stamped.  No discussion and a vote was taken.  In favor:  S. Stutts, J. McQuade, A. Sibley, R. Smith, M. Stone   In opposition:  None   Opposed:   None  The Motion passed unanimously.  5-0-0

Reasons to grant:  A reasonable update to the property, narrow lot and reducing nonconformities.  Proposal is within the intent of zoning.  

Case 12-26 – Margaret Rockwell, 44 West End Drive

        A Motion was made by A. Sibley, seconded by M. Stone to GRANT the necessary variances as per the plans stamped.  No discussion and a vote was taken.  In favor:  S. Stutts, J. McQuade, A. Sibley, R. Smith, M. Stone   In opposition:  None   Opposed:   None  The Motion passed unanimously.  5-0-0

Reasons to grant:  Small lot, improvement makes the property more livable, in harmony with the neighborhood and within the intent of zoning.  

Minutes of the September 18, 2012 Regular Meeting

        A Motion was made by J. McQuade, seconded by R. Smith and voted unanimously to approve the minutes of the September 18, 2012 Regular Meeting with the following corrections:  page 4, first line change “vice” to “versus”; page 4, last paragraph, after “Mr. Laliberte” add “Architect”; Page 6 Case 12-21 where it says “Chairman Stutts” it should read “Acting Chairman McQuade”.  No discussion and a vote was taken.  In favor:  S. Stutts, J. McQuade, A. Sibley, R. Smith, M. Stone   In opposition:  None   Abstaining:  None   The motion passed unanimously. 5-0-0

Adjournment

        A Motion was made by A. Sibley, seconded by J. McQuade to adjourn the October 16, 2012 Regular Meeting; no discussion and a vote was taken.  The motion to adjourn passed unanimously.  5-0-0    The meeting adjourned at 9:32.m.

The Zoning Board of Appeals next regular meeting will be Tuesday, November 20, 2012.  There is no December meeting.
